RESERVATION CONDITIONS

GENERAL BOOKING CONDITIONS

By booking an experience with Marmitako Sailing SL, you agree to be bound by each of these terms and conditions. Participation in any of our activities implies that you have read and accepted all of these General Terms and Conditions. If one person registers another person or persons, they assume all of these General Terms and Conditions on their behalf.

Article 1. RESERVATIONS

Reservations: Reservations will not be considered valid, nor will they carry any associated rights, until a deposit of 50% of the total activity cost has been paid. Activity cancellations: Clients may cancel contracted services and are entitled to a refund of all amounts paid, less administrative and cancellation fees. These fees are calculated as follows:

More than 90 days before the reserved date → The money paid is refunded, but 15% is deducted from the total budget.

Less than 60 days before the reserved date → A 40% discount is applied to the total budget.

30 days or less before the reserved date → A 60% discount is applied to the total budget.

15 days or less before the reserved date No refund , as 100% of the total budget is deducted.

The client accepts that the reservation may be modified by the company in cases of force majeure, vessel maintenance, technical unforeseen events or port restrictions, without the right to additional claim.

Article 2. CONDITIONS REGARDING THE RESERVATION PROCEDURE AND COMMUNICATION CHANNELS

Reservations will be fixed and blocked only and exclusively once 50% of the total amount of the contracted service has been paid, and the corresponding proof of the transfer or payment method used has been sent to the administration.

Until said proof has been received and validated, the date will not be considered reserved or committed by the company.

The company reserves the right to assign the date to another group that first makes the required payment and sends the proof of payment in a timely manner, without any commitment to other people who have previously expressed their interest verbally or by message.

Simply expressing interest or the intention to reserve a date does not constitute an effective reservation or guarantee availability.

Claims arising from misunderstandings due to messages sent indicating “wanting to book” will not be accepted if they have not been accompanied by the corresponding payment and proof of payment.

The fee for booking services at the nautical school cannot be applied as a discount or compensation for any other company services, such as boat rentals or other leasing options or promotions, including those offered as gifts. Furthermore, all bookings must be made exclusively via email, which will be the official channel for all formal communications, receipts, confirmations, and modifications.

WhatsApp messaging will be used solely for informational purposes or for brief inquiries, and cannot be considered a valid channel for making reservations, sending receipts, or receiving official or binding responses.

The client agrees that the company may contact them via email, WhatsApp, or telephone for notifications regarding safety, itinerary changes, weather conditions, vessel maintenance, or any other situation that may affect the activity. Such communications will be considered contractually binding.

Article 3. PUNCTUALITY

If 10 minutes have passed since the scheduled time at a meeting point for an activity and the client has not notified the organizers of the delay, the boat will leave the meeting point and no refund will be issued. Similarly, in the event of a delay with prior notification, Marmitako Sailing will shorten the activity proportionally, if possible.

In the event of significant delays that affect the logistics of the activity or other bookings, the company reserves the right to charge additional expenses for time and personnel.

Article 4. WEATHER CONDITIONS AND POSSIBILITY OF RESCHEDULING

The departure may only be rescheduled if weather conditions pose a real risk to the safety of the crew or passengers .

In situations where the sea state is moderate (drizzle, rain, small/medium waves, wind or others) but does not prevent the safe performance of the service, the activity will be carried out as planned (Art. 5). In these cases, the company does not offer changes, refunds, or rescheduling.   Cloudy, cold or low visibility conditions will not be grounds for cancellation, provided the activity can be carried out safely.

Marmitako Sailing SL reserves the right to change the date of the activity or program contracted due to adverse weather, meteorological and/or hydrological conditions, trying as far as possible to satisfy the client. In the event that the dates do not suit you, 100% of the reservation fee for the contracted activity will be refunded (taking into account management and cancellation costs).

The company informs the customer that the sunset experience, or unusual experiences such as viewing a lunar or solar eclipse, or other phenomenon, is subject to weather and natural factors, such as dense cloud cover or other atmospheric phenomena, which are beyond the company’s control. The customer accepts that weather and natural factors beyond the company’s control may prevent the sunset from being visible.


Therefore, the company does not guarantee sunset viewing and expressly reserves the right not to issue refunds if the sunset cannot be seen. Making a reservation implies full acceptance of these conditions and the client’s assumption of the risk.

Any modification or suspension of the activity once it has started, due to causes beyond the control of the organization, will not imply any refund or replacement of the activity, so we will try to start the activity under the most favorable conditions possible.

The client accepts that Marmitako Sailing may modify itineraries, schedules, routes or services to ensure safety, legal compliance, port availability or ship maintenance, without obligation of additional compensation.

For the activities, Marmitako Sailing SL will provide all the necessary technical equipment, both individual and group. Each technical sheet specifies the equipment that the client must bring to the activity .

The client is responsible for bringing the required personal equipment and any failure to do so may result in the total or partial cancellation of the activity without refund.

Article 5. CONDITIONS REGARDING VOLUNTARY CANCELLATIONS BY THE CLIENT

In the event that the client decides to voluntarily cancel a previously booked outing, the company reserves the exclusive right to accept or reject said cancellation, as well as to decide whether a partial or full refund is appropriate, or whether the activity should be rescheduled for another date, which will be strictly subject to availability. The client may not demand a specific date or guarantee the same vessel, service or conditions initially contracted.

Likewise, if the contracted activity can be carried out safely —according to the technical criteria of the employer and/or the company—, it will be carried out on the agreed date and time.

The existence of mild or moderate adverse weather forecasts, such as possible intermittent rain or cloudy skies, will not be considered a justified cause for cancellation or for the refund of the amount paid.

Consequently, if the client decides not to attend or participate in the activity for personal or subjective reasons —including non-impeding weather forecasts—, it will be understood as a voluntary, non-refundable cancellation, and the company will not be obligated to refund or offer a new date.

Any absence of the client, unjustified delay, unilateral decision not to participate or abandonment of the activity is considered a voluntary cancellation.

Mild or moderate weather forecasts, personal opinions about the route, or changes in the customer’s mood are not considered valid reasons for voluntary cancellation.


Article 6. CONDITIONS IN CASE OF ACTIVITY WITH GASTRONOMIC SERVICE

In those reservations that include onboard food service, and provided that weather conditions allow the safe performance of the activity according to the criteria of the skipper or the company, if the client unilaterally decides not to go out, it will be considered as a voluntary cancellation by the client.

In that case, the amount corresponding to the catering service will not be refunded, since this is prepared specifically for the contracted date and generates non-recoverable costs.

However, the client may reschedule the departure for another available date, in accordance with our general terms and conditions for modifying reservations. The new date will be subject to availability and the same conditions initially agreed upon, without prejudice to the charge corresponding to the unrefunded meal portion.

Article 7. INSURANCE

Marmitako Sailing SL has all its legal registrations up to date: Civil Liability Insurance, SOVI for passengers, and assistance for each vessel. These will be available to clients provided the conditions detailed here are met:
Marmitako Sailing SL will never be held responsible for any accident or provide its insurance for causes that are not strictly its responsibility.
Marmitako Sailing SL will be responsible in case of: poor condition of the materials or negligence of one of the monitors.
Marmitako Sailing SL will not be liable in the event of: weather conditions, lack of attention or negligence on the part of the client, lack of physical fitness of the client or illnesses of the client, injuries prior to the activity.
Claims within the Deadline: Claims will only be valid if made immediately after the activity ends .

Marmitako Sailing SL will not be liable for accidents caused by customer negligence, failure to comply with safety regulations, consumption of alcohol or drugs, acts of third parties, extreme weather conditions, force majeure, pre-existing illnesses or lack of physical preparation of the customer. (Art. 16)

The company will only be liable in cases of negligence by its staff or poor condition of the materials provided.

The client declares that they are in adequate physical and medical condition to participate and agrees to report any medical condition that may affect the activity.

All claims must be submitted immediately upon completion of the activity; subsequent claims will not be accepted.

Article 8. GENERAL RENTAL CONDITIONS

The rental company is not responsible for thefts, robberies, losses or damages that the renter and/or passengers of the vessel may suffer during the rental period, nor for personal belongings left on board or in ports.


The company, the employers, or any agent within it, assumes no responsibility for the loss, theft, or damage of food, beverages, or other items that the client brings in or leaves in their custody before the departure date, as these items are outside the control and protection of the company.

If breakdowns occur prior to the preceding rental period, or during the same rental period, or for any reasons beyond the control of the lessor, the lessor may provide the contracting party with a vessel of similar characteristics or return the proportional part of the unfulfilled rental period less one day without further liability.

If the vessel is of a lower category than the one contracted, MARMITAKO SAILING SL will refund the proportional difference in rental values, less one day. The charterer may not claim compensation or damages.

In the event that the start of the activity experiences a significant delay due to causes attributable to the company, the company undertakes to compensate for this time by extending the duration of the rental as far as possible.

If the client decides to voluntarily extend the trip beyond the initially contracted time, an additional charge of €190 per hour will be applied, calculated based on operating expenses, including the skipper’s working hours, fuel and other related factors, such as the possible impact on the scheduling of subsequent activities.

The consumption of alcohol and/or narcotics on board the vessel is strictly prohibited. Failure to comply with this rule may result in immediate suspension of service and expulsion of the offender, without any right to a refund. The company reserves the right to take any measures it deems necessary to ensure the safety of all passengers and crew.

In the event of a breakdown during the rental period, the contracting customer is authorized to carry out the repair for normal wear and tear of the material and equipment up to a total not exceeding 150 euros. The lessor will pay this amount at the end of the rental period upon presentation of the invoice issued in the name of the company MARMITAKO SAILING SL

The customer is responsible for any damage, breakage, loss or misuse of the vessel, safety equipment, inventory items, accessories or sporting goods provided.

Additional charges may apply for extra cleaning, replacement of equipment, or repair of damage caused by the renter or their companions.

It is forbidden to transfer the vessel or its equipment to third parties without written authorization from Marmitako Sailing SL

The company can document the condition of the boat before and after the rental by means of photographs or a detailed inventory, and damage charges will be calculated based on this evidence.

The lessee accepts that Marmitako Sailing is not responsible for delays or cancellations caused by force majeure, port problems, government restrictions, maritime traffic or accidents of third parties.

The client declares that they are in adequate physical and medical condition to participate and agrees to report any condition that may affect the safety or development of the activity.

Article 9. CONDITIONS FOR THE USE OF THE VESSEL

The contractor undertakes to use the rented ship in accordance with the regulations of the Maritime, Customs, Treasury, Police and Health authorities, being solely and exclusively responsible for the consequences of infringement or non-compliance with said official provisions.

The Renter agrees to use the vessel properly and maintain it in good condition, and is responsible for the integrity of all items included in the inventory. Therefore, the Renter will be liable for any damage, breakage, theft, or loss that may occur.

Cabins: During half-day or “day charter” departures, the cabins will not be in use, and therefore will not be available for use by passengers.

Footwear on board: Sports shoes or similar footwear is recommended. The use of shoes with black rubber soles, flip-flops, boots, or high heels is expressly prohibited in order to preserve the safety and condition of the vessel.

The lease period may not be changed, except with the agreement of the lessor.

Any extension or modification of the rental period will require prior consultation and approval from the LESSOR. Should the lessee decide, on their own initiative, to exceed the agreed rental period, a charge of €190 will be applied for each additional hour or fraction thereof. The vessel must return to port before the agreed time.

In the event that the captain observes any disrespect, impediment to the proper development of the work, mistreatment or inappropriate conduct on the part of the clients, he may make the decision to return to land immediately, terminating the rental without the right to a refund.

The ship’s captain will always have the final say regarding the itinerary to be followed. If, for reasons of safety, weather or other circumstances, it is necessary to modify the route, the captain’s decision must be obeyed, who will act in accordance with current maritime legislation .

Bringing pets without written authorization is prohibited.

The client is responsible for the conduct of their companions and for any damage they may cause.

Jumping into the water, maneuvers, or activities not authorized by the skipper are not permitted.

The client must inform about medical conditions, allergies, physical limitations or any circumstance that may affect the safety of the activity.

The company may modify itineraries, schedules, services, routes or times without obligation of additional compensation if required by safety, weather conditions, logistics or regulations.

Article 10. CONDITIONS REGARDING PROPOSALS AND BUDGETS:

The proposals issued by the company are personalized and adapted to each request, and may vary according to the number of people, added services, dates, availability or level of quality offered.

The existence of price differences between similar proposals does not obligate the company to match rates nor does it give rise to any right to claim. The company reserves the right to adjust conditions or prices according to the context of each request.

The company does not recognize that any request or circumstance raised by the client constitutes an automatic reason for applying discounts to issued quotes or proposals. The decision regarding any price modifications rests solely with the company’s Manager, who will act at their discretion and with their authority.
The prices set are calculated to cover the vessel’s operating costs, including but not limited to fuel, insurance, cleaning, and skipper.

The economic offers are valid exclusively for the person or entity to whom they are addressed, and may not be shared, forwarded or used by third parties without express written authorization.

The validity of any proposal is: 15 calendar days from the date of issue.

Article 11. CONFIDENTIALITY CLAUSE

All information contained in any proposal issued by Marmitako Sailing SL is confidential and for the exclusive use of the recipient. Its disclosure, reproduction, or distribution, in whole or in part, is prohibited without the company’s prior written consent.

Article 12. LEGAL NOTICE

The content of any proposal does not constitute a binding contract until the reservation is expressly confirmed in accordance with the conditions established by Marmitako Sailing SL. Any misuse of this information may be subject to legal action in accordance with current regulations.

The booking confirmation implies full acceptance of all the conditions in Articles 1 to 13, including modifications due to security, logistics, weather or force majeure. Typographical errors, changes in rates, schedules, itineraries or vessel do not generate the right to claim. The company is not responsible for misinterpretations of information published on the website, emails, quotes or messages, and the booking may be cancelled by the company in case of breach of any condition, non-payment or inappropriate conduct, without the right to a refund.

Article 13. COMMITMENT TO CONDUCT ON BOARD

Article 13.1. Obedience to the Boss and Safety Standards

The client agrees to follow at all times the instructions given by the captain of the vessel, who holds the highest authority on board in matters of safety and crew coordination.

The skipper may modify itineraries, schedules or services if required by safety, current regulations or weather conditions, without obligation to compensate, and the client accepts that any breach of safety rules may result in immediate suspension of the activity.

Article 13.2. Collaborative Attitude and Active Participation

The client undertakes to actively participate in the ship’s common maneuvers and tasks, including when collaboration is required, such as for taking turns or attending courses, maintaining a positive, constructive, and proactive attitude that contributes to a good atmosphere and overall functioning.

The client must respect the employer’s specific instructions regarding safety, use of equipment, and conduct during the activity.

Article 13.3. Respect and Coexistence

The client agrees to maintain respectful conduct towards all crew members, avoiding any form of contempt, discrimination or conflict.

The client is responsible for the conduct of their companions and any damage they may cause, and dangerous, aggressive or inappropriate conduct may result in immediate exclusion from the activity without the right to a refund.

Article 13.4. Consequences of Non-Compliance

The client accepts that, in the event of non-compliance with any of these rules of conduct, the skipper and/or the management team of Marmitako Sailing may take the measures they deem necessary, including possible exclusion from the activity without the right to a refund, except in duly justified cases or force majeure.

Article 13.5. Consumption of food and beverages on board

The client agrees not to use any food or beverages belonging to the ship without prior authorization or without having paid for them. In the event of unauthorized consumption, the corresponding amount will be automatically charged to their account according to the rates established by the organization.

Article 13.6. Ethical and Participatory Commitment

The client declares their willingness to foster a safe, inclusive and participatory environment during any experience, allowing all crew members to be involved equally in nautical and shared activities .

By making a reservation with Marmitako Sailing SL, the client expressly accepts the terms and conditions set forth in Articles 1-16. Furthermore, the client agrees to comply with all legal and regulatory provisions applicable to the use of recreational vessels, especially those contained in Royal Decree 875/2014 of October 10, which regulates nautical qualifications for the operation of recreational vessels, and in the Spanish Commercial Code, regarding maritime lease agreements and liability during transport.

Article 14. CUSTOMER LIABILITY AND SUPPLEMENTARY INSURANCE

The client acknowledges that they are responsible for their own safety, the safety of their companions, and any third party who comes on board, and that Marmitako Sailing SL is only liable for damages caused by negligence on the part of the company or the skipper. The client accepts that the use of a life jacket is mandatory in situations indicated by the skipper, and that any failure to comply with this rule releases Marmitako Sailing from liability for accidents. The company recommends purchasing additional travel, health, accident, or liability insurance to cover damages to the customer or third parties. It is the customer’s sole responsibility to obtain such insurance. Marmitako Sailing SL is not liable for losses, injuries, or accidents resulting from the lack of additional insurance coverage purchased by the customer.

Article 15. USE OF IMAGES, VIDEOS AND SOCIAL NETWORKS

The client expressly authorizes Marmitako Sailing SL to take photographs, videos, or recordings during the activity for promotional, advertising, or dissemination purposes on social media, the company’s website, or other media outlets, unless the client provides written notice of their refusal before the activity begins. The client agrees to respect the privacy of other passengers and crew and not to publish images or data of third parties on social media without their consent. Marmitako Sailing SL is not responsible for external publications made by third parties during the activity that may affect the privacy of the participants.

Article 16. HEALTH CONDITIONS AND PHYSICAL REQUIREMENTS

The client declares that they are in adequate physical and health condition to participate in the contracted activity and agrees to inform Marmitako Sailing SL of any medical condition, physical limitation, allergy, illness, or situation that may affect their safety or the safety of others. The company may limit the participation of any client whose condition puts the safety, the development of the activity, or the integrity of the vessel at risk. Marmitako Sailing SL is not responsible for accidents, injuries, or complications arising from medical conditions not previously disclosed by the client.

CONDICIONES DE LA ESCUELA NÁUTICA (FORMACIÓN Y PRÁCTICAS)

Artículo 1. Objeto y ámbito de aplicación

Las presentes Condiciones Generales regulan los términos aplicables a la cancelación, modificación y devolución de importes correspondientes a las reservas de prácticas náuticas formativas organizadas por Marmitako Sailing.

Estas condiciones serán de aplicación a todas las actividades prácticas vinculadas a titulaciones náuticas de recreo (incluyendo, entre otras, PNB, PER, Patrón de Yate, Capitán de Yate o equivalentes), así como a cualquier otra formación práctica impartida por la escuela.

La formalización de la reserva implica la aceptación expresa y sin reservas de las presentes condiciones.

Artículo 2. Formalización de la reserva

La reserva de plaza en cualquiera de las prácticas se considerará confirmada únicamente tras la recepción del pago correspondiente y el contrato matrícula relleno, ya sea total o parcial, conforme a las condiciones comunicadas en el momento de la contratación.

Dada la naturaleza de las actividades, el número de plazas es limitado, por lo que la asignación de fechas y plazas tiene carácter nominal y vinculante desde el momento de la confirmación.

Artículo 3. Cancelación por parte del cliente
3.1 Cancelación voluntaria

En caso de desistimiento por parte del alumno, se aplicará el siguiente régimen:

Cancelaciones comunicadas con más de 15 días naturales de antelación respecto a la fecha de inicio de las prácticas:
El cliente tendrá derecho a:
La devolución de las cantidades abonadas, pudiendo descontarse los gastos de gestión administrativa que procedan, o
La modificación de la reserva a una nueva fecha, sujeta a disponibilidad.
Cancelaciones comunicadas entre 15 y 7 días naturales de antelación:
No procederá la devolución de las cantidades abonadas.
Se permitirá, de forma excepcional, el cambio de fecha, sujeto a disponibilidad.
Cancelaciones comunicadas con menos de 7 días naturales de antelación, o no presentación del alumno:
No se tendrá derecho a devolución.


3.2 Cesión de la reserva

El cliente podrá ceder su plaza a un tercero, siempre que:

Se comunique a Marmitako Sailing con un mínimo de 48 horas de antelación.
El cesionario cumpla con los requisitos legales y administrativos exigibles para la realización de la práctica.


Artículo 4. Condiciones meteorológicas y de seguridad

Las prácticas náuticas están condicionadas por factores meteorológicos y de seguridad marítima.

La decisión final sobre la realización, modificación o cancelación de la actividad corresponderá exclusivamente al patrón responsable o a la dirección de la escuela, en atención a criterios de seguridad.

En caso de que las condiciones meteorológicas o del estado de la mar sean consideradas adversas y desaconsejen la realización de la actividad:
Se procederá a la reprogramación de la práctica sin coste adicional para el alumno.

No se considerarán causas de cancelación:
Lluvia moderada 
Nubosidad
Condiciones normales de viento o mar que permitan una navegación segura
Oleaje
Frío, o bajas temperaturas.

Artículo 5. Cancelación por parte de la empresa

Marmitako Sailing se reserva el derecho de cancelar o modificar una práctica en los siguientes supuestos:

Condiciones meteorológicas adversas
Incidencias técnicas o averías en la embarcación
No alcanzarse el número mínimo de participantes requerido (en su caso)
Causas de fuerza mayor o circunstancias imprevistas

En tales casos, el cliente tendrá derecho a elegir entre:

La reprogramación de la actividad en las fechas que mejor le encajen.


Artículo 6. Interrupción de la actividad

En caso de que, una vez iniciada la práctica, esta deba ser interrumpida o modificada por razones de seguridad, condiciones meteorológicas sobrevenidas u otras causas justificadas, no procederá devolución alguna, siempre que la actividad haya comenzado conforme a lo previsto. La empresa podrá programar otro día para recuperar esas horas no computadas.

Artículo 7. Puntualidad y asistencia

El alumno deberá presentarse en el lugar, fecha y hora indicados en la confirmación de la reserva.

La falta de puntualidad o la no presentación que impida el desarrollo normal de la actividad implicará la pérdida del derecho a participar en la misma, sin posibilidad de devolución o cambio.

Artículo 8. Condiciones personales del alumno

El alumno declara, bajo su responsabilidad, que reúne las condiciones físicas y de salud adecuadas para la realización de la actividad.

El abandono voluntario de la práctica una vez iniciada no dará derecho a reembolso alguno.

Artículo 9. Naturaleza de la actividad

El cliente reconoce que las prácticas náuticas se desarrollan en un entorno natural, sujeto a variabilidad, lo que puede implicar ajustes en rutas, horarios o contenidos, siempre bajo criterios de seguridad y operatividad.

Artículo 10. Aceptación de las condiciones

La contratación de cualquier práctica organizada por Marmitako Sailing implica la aceptación plena de las presentes Condiciones Generales de Cancelación y Devoluciones.
